1. Heard.

2. By means of this petition, moved u/art. 226 of the Constitution of India, petitioner has sought writ in the nature of mandamus, commanding the respondent nos.1 and 3 to decide the representation of the petitioner for his transfer from Government P.G. Degree College, Pithoragarh.

3. Learned counsel for the petitioner states that the petitioner was appointed as a Lecturer in Zoology in Government P.G. Degree College, Pithoragarh on 14.12.1998. It is further stated that he is working in the said College for more than 14 years but he has still not been transferred. It is further stated that he made several representations to the respondent nos.1 and 3 but no heed was paid to the same.

4. In the counter affidavit filed on behalf of respondent no.3, it has been stated that in future, while making annual transfers, petitioner’s case will be considered as per Rules.

5. Having considered the submissions of learned counsel for the petitioner and learned counsel for the respondents and after going through the affidavit and counter affidavit on record, we are of the view that this writ petition deserves to be disposed of with the direction to the respondent no.1 to take a decision on the representation of the petitioner.

6. Accordingly, the writ petition is disposed of with a direction to the Principal Secretary, Higher Education, Government of Uttarakhand, Dehradun to take a decision on the representation dated 12.03.2013 (Annexure no.6 to the petition) made by the petitioner within a period of three months from the date of production of certified copy of this order in the office of the said Authority.
