(UNI) The Delhi High Court today dismissed the petition of the two accused involved in the December 16 gangrape case seeking to quash the FIR and subsequent proceedings against them in the case.
Justice Pratibha Rani while dismissing the plea of accused Mukesh and Akshay to quash First Information Report(FIR) against them and also rejected their plea to conduct trial on alternate days instead of the ongoing day-to-day trial being held in Saket District Court.
The HC upheld the decision of the special fast track court judge(Saket court) directing a day-to-day trial in the case as this particular case had drawn the attention of entire country and public outrage was witnessed.
The Saket Court judge had on March 28 dismissed the plea of the two accused who sought to conduct proceedings on alternate days instead of day-to-day so that their counsel gets some time to seek instructions from them on cross-examination of witnesses.
The trial court had dismissed their plea, saying ‘Such pleas are made to delay the proceedings.’
The Police had arrested total six accused including the owner of the bus who was allegedly involved in the rape and murder of 23-year-old paramedical student. The rape was committed by five of them in a moving bus on December 16 last.
One of the accused is less than 18 years of age so he is being tried in the Juvenile Justice Board. The main accused Ram Singh has been abated in the case after he allegedly committed suicide in Tihar jail on March 11.
With the proceedings against the main accused Ram Singh having abated after his death, the accused Mukesh, Vinay, Akshay and Pawan Gupta are facing trial in the case for rape and murder of the girl.
The victim of the gangrape along with her boyfriend were brutally attacked by the accused in the moving bus and were thrown out in a naked condition after committing rape on the girl.
The girl who suffered grievous injuries was initially treated in the Safdarjung Hospital in Delhi but later when her condition deteriorated, was shifted to a hospital in Singapore where she succumbed to injuries on December 29 last.
Her boyfriend, though survived, is suffering from multiple fractures which may lead to a life long physical impairment. UNI
